2. Eligibility
By purchasing or using the M3U IPTV app, you confirm that you are at least 18 years old (or the age of majority in your country of residence). Purchases by minors are not permitted without parental or guardian consent.
3. General Responsibility
Users are solely responsible for any playlists, channels, or content accessed or played using the app. Herber eDevelopment does not provide playlists or channels and assumes no responsibility for third-party content. Users must comply with applicable laws and are liable for any damages or legal consequences resulting from non-compliance.
4. Availability
Herber eDevelopment reserves the right to modify, suspend, or discontinue the app or any of its services at any time without prior notice or liability. There is no guarantee of continuous availability or future feature updates.
5. Changes to Features
App functionality, including Premium features, may be modified, restricted, or removed at any time for technical, legal, or business reasons.
6. Payments
Payments via our website are accepted using selected cryptocurrencies such as Ethereum and Solana, as well as via Stripe.
By using Stripe as a payment method, you agree that Stripe’s Terms of Service and Privacy Policy apply to the processing of your payment.
Purchases made through the Google Play Store are processed directly by Google. Refunds or cancellations for Google Play purchases must be handled exclusively through Google Play and are subject to Google’s policies.
⚠️ Cryptocurrency transactions are subject to network fees, confirmation delays, and exchange rate fluctuations. These factors are non-refundable.
7. Products & Mandatory Testing
The M3U IPTV app is a media player only. We do not sell, provide, or include playlists, channels, or third-party content.
Before purchasing a license, users are explicitly required to test the app using the free version on all intended devices.
A Premium test phase is available and must be used prior to purchase. The test phase can be activated up to three (3) times for one (1) hour each via the app settings under the section "License".
⚠️ By completing a purchase, the customer confirms that the app, playlist compatibility, device compatibility, and Premium features have been sufficiently tested.
Refunds or disputes based on unmet expectations, missing playlists, incompatibility, or failure to test will not be accepted.
8. Digital License Keys – No Refund Policy
8.1 Immediate Delivery & Loss of Withdrawal Right
For German and EU consumers: In accordance with Section 356 (5) of the German Civil Code (BGB) and the EU Consumer Rights Directive, by expressly consenting to immediate delivery during checkout, the customer waives their statutory right of withdrawal.
8.2 No Refunds After Purchase
All license keys are delivered digitally and are considered non-refundable once provided, regardless of whether the license key has been activated or redeemed.
This applies in particular, but not limited to:
- Failure to test the free version or Premium test phase
- Incompatible playlists or third-party content
- Unsupported or incompatible devices
- Incorrect assumptions about included features or content
- User misunderstanding of the product description
⚠️ This policy applies only to purchases made via our website. Purchases via Google Play are governed solely by Google’s refund policies.
8.3 Mandatory Checkout Confirmation
Before completing a purchase, the customer must confirm via a mandatory checkbox:
“I have tested the app, my playlists, and the Premium features using the free version and available test phases. I understand that no refunds are offered after purchase.”
This confirmation is binding and serves as proof of informed consent.
9. Refund Policy
Due to the digital nature of the product and the availability of extensive testing options, no refunds are offered for license purchases made via our website.
10. Force Majeure
Herber eDevelopment is not responsible for service interruptions caused by events beyond reasonable control, including but not limited to operating system updates, device restrictions, third-party service outages, natural disasters, or other unforeseeable events.
11. License Deactivation
In the event of abuse, fraud, or violation of these Terms, licenses may be revoked without refund or compensation.
12. Support
Support inquiries can be sent to support@m3u-ip.tv.
13. International Users
These Terms apply worldwide. EU consumers retain mandatory statutory rights where applicable. Users outside the EU must comply with local laws.
14. Privacy / Data Usage
Personal data is processed in accordance with our Privacy Policy. By using the app or completing a purchase, you consent to such processing.
15. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws remain unaffected.
16. Changes to Terms & Severability
We reserve the right to amend these Terms and Conditions at any time. The version in effect at the time of purchase shall apply, unless changes are required by law or official order.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.
